END USER LICENSE AGREEMENT

By downloading the software file, the end user agrees with this End User License Agreement

  1. FLARM devices are only given to users who have actively and in written agreed to all the items of this End User Agreement. This FLARM device is solely used by the person signing this End User Agreement. This End User Agreement may also be printed, signed by the user and sent to FLARM Technology GmbH, Waserstrasse 83, 8053 Zurich, Switzerland.
  2. FLARM cannot warn in all situations, in particular warnings may be incorrect, late, missing, not being issued at all, show other threats than the most dangerous and distract the pilot's attention. FLARM does never issue collision avoidance advice. FLARM can only warn of aircraft that are equipped with FLARM or a compatible device or of obstacles as stored in its database. The use of FLARM does not allow a change of flight tactics or pilot behaviour. It is the sole responsibility of the user and pilot in command to decide upon the use of FLARM.
  3. FLARM may not be used for navigation, separation or any non-VFR activity.
  4. The most recent OPERATION MANUAL and INSTALLATION MANUAL must be read, understood and followed at all times. It is known that the software has a defined expiry date and must be replaced an a defined date.
  5. After power-up FLARM performs a self-test which must be monitored by the user. If malfunctioning is observed or suspected, FLARM must be removed from the aircraft immediately and the device inspected.
  6. FLARM may not be installed or used in aircraft registered in the US or Canada, in US or Canadian airspace, with a departure or arrival destination in the US or Canada or with a US or Canadian citizen or person on board.
  7. The user and pilot are solely responsible to operate FLARM according to the applicable jurisdiction. Restrictions might apply, namely but not limited to airborne usage of SRD-radio transmission, aircraft installation, safety regulation and regulations for sports competitions.
  8. No part of the PC software, the FLARM device software, the FLARM obstacle database and the FLARM hardware and design shall be copied, altered, reverse engineered, decompiled or disassembled without an explicit and written approval by FLARM Technology GmbH. The PC software, the FLARM device software, the FLARM obstacle database, the FLARM hardware and design, the FLARM logo and name are protected by copyright, trademark and patent laws in different countries.
  9. It is forbidden to intentionally feed artificially generated signals to the FLARM unit, its GPS antenna or the external/internal GPS antenna connections which behave comparable to GPS satellite vehicles operated by US DoD.
  10. Data provided by FLARM devices may be used at own risk and under the same conditions as the FLARM device itself. FLARM Technology GmbH is not responsible for any third party device using data provided by FLARM devices.
  11. FLARM Technology GmbH, its bodies, employees, contractors, consultants and developers as well as licensees cannot be held liable under any circumstances.
  12. Legal venue is Zurich (Switzerland), Swiss law applies.
